Terms of Service

Last updated: [Fill in date before launch] · Applies to the services between Apply Job HK (the "Service", "we", "us") and you (the "Client", "you").

⚠️ Template draft — must be reviewed by a lawyer before use. These terms touch on the compliance boundaries of several laws, including the definition of an employment agency under Hong Kong's Employment Ordinance (Cap. 57), the Personal Data (Privacy) Ordinance and the Trade Descriptions Ordinance. They must be reviewed by a Hong Kong lawyer, and you must obtain a written opinion on the question of "whether this constitutes an employment agency", before formal adoption. This is an English translation provided for convenience; in the event of any discrepancy, the Traditional Chinese version prevails.

1. Nature of the service

This Service provides job-seekers with CV writing and optimization, cover letters, LinkedIn profile optimization, interview preparation, career consultation, and the submission of job applications on the Client's behalf as chosen by the Client ("application assistance").

We are not an employment agency. We do not source, match or recommend specific employers for the Client, do not establish any recruitment relationship with employers, and do not charge any placement or job-introduction fee. Which roles to apply for is selected and finally confirmed by the Client; we only provide assistance with the paperwork and submission for the roles the Client selects.

2. No guarantee of employment

We do not guarantee that you will obtain any interview, hire or particular outcome. What we promise is to write your CV to a professional standard, apply accurately according to your choices, and do our best to improve your chances of success. You should treat any service that claims to "guarantee employment" with caution.

3. The Client's responsibilities

4. Third-party platform terms

When we submit applications or operate online accounts on your instruction, those actions are subject to the terms of use of the relevant third-party platforms (such as LinkedIn, JobsDB, etc.). Some platforms may restrict third parties from operating accounts on your behalf; you understand and agree that any action taken against your account as a result is at the risk of the account holder. We act manually, with your authorization, and do not use automated programs.

5. Fees and payment

All fees are charged for the service or paperwork itself and are independent of whether you are hired. We do not charge any placement fee, success fee, or commission calculated as a proportion of salary. Fees and payment methods are set out at the time of ordering.

6. Subscription-based application assistance

The apply-on-your-behalf service runs in cycles of 30 calendar days (including weekends and public holidays). The application limit, progress-reporting method and included content of each plan are set out at the time of ordering. A "completed application" means we have tailored your CV and cover letter to a role you selected and submitted it. You may cancel your renewal under the cancellation terms below.

7. Refunds and cancellation

We offer a quality-based money-back guarantee: if you are not satisfied with the quality of your CV or our service, you may request a refund within [suggested: e.g. 7 to 30 days] under our terms. Please note that refunds are based on service quality, not on whether you obtain an interview or hire — we do not guarantee outcomes and therefore offer no outcome-linked refund. Cancellation of a subscription service must be notified before the start of the next cycle [suggested: X days in advance]. Detailed refund arrangements are set out at the time of ordering.

8. Limitation of liability

To the maximum extent permitted by law, our total liability in relation to this Service shall not exceed the fees you have paid for the relevant service. We are not liable for indirect, incidental or consequential losses. These terms do not exclude any liability that cannot be excluded by law.

9. Personal data

We handle your personal data in accordance with Hong Kong's Personal Data (Privacy) Ordinance and this website's Privacy Policy. By using this Service, you confirm that you have read and understood that policy.

10. Governing law

These terms are governed by the laws of the Hong Kong Special Administrative Region and subject to the jurisdiction of the Hong Kong courts.
